Employment Update

From 1st April 2009 there are number of employment law changes and updates. Bear the following in mind:

1st April

The statutory holiday entitlement is changing. The holiday entitlement increases from 24 days to 28 days. The holiday entitlement can include bank holidays. This is pro rata’d for part time staff.

5th April

The standard weekly rate of SMP (Statutory Maternity Pay) and the weekly rates of SAP (Statutory Adoption Pay) and SPP(Statutory Paternity Pay) increase from £117.18 to £123.06 per week

6th April

  • The right to request flexible working is to be extended to parents of children up to the age of 16 or a disabled child under 18.
  • The statutory dispute resolution procedures are being abolished and the ACAS code introduced.
  • The right to time off work for public duties is to be extended to employees in a wider range of civic roles from 6 April 2009.
  • The weekly rate of SSP (Statutory Sick Pay) increases from £75.40 to £79.15 per week.
  • The lower earnings limit for qualifying for SMP (Statutory Maternity Pay) SAP(Statutory Adoption Pay) and SPP(Statutory Paternity Pay) will rise to £95.00 per week.
  • The other provisions of the Employment Act 2008 will come into force from 6 April 2009, including changes to enforcement of the national minimum wage (NMW) changes to trade union membership law and changes to ACAS conciliation

MCA can provide support to the application for Investors in People and Quality Standards.

Staff Contracts/Handbooks

MCA will review Human Resource policies and procedures including the options relating to staff contracts and handbooks to establish the client’s position on these issues, plus a review of appropriate information relating to hours and holiday entitlements allowing individual staff contracts to be completed. A bespoke staff handbook and individual staff contracts will then be written.

Health & Safety

MCA will address H&S issues and complete a gap analysis against current regulations. MCA will set up policy and a full manual incorporating management and employee responsibilities, emergency procedures and risk and fire audits plus advice on signage and equipment.
